This agreement ("terms and conditions") sets out legally binding terms and conditions ("agreement") for using any website, governed by Vicky Moore ("I", "me" or "my"), including but not limited to cherrisilk.co.uk and all pages hosted by kartra on behalf of Vicky Moore including the HERintimacy membership.  By continuing to use these sites ("cherrisilk.co.uk", "pages hosted on kartra on behalf of Vicky Moore") you are agreeing to abide by these terms and conditions, and any future updates. 

User eligibility and obligations

When you make a purchase on my website, you confirm that you meet the required legal age to buy the items. If I find that you do not meet the legal age for certain product purchases, I retain the right to cancel your order. By using the Website, you agree to utilize it solely for lawful purposes and in a manner that does not infringe upon the rights of, or obstruct or hinder the use and enjoyment of the site by any third party. Such obstruction or hindrance encompasses, but is not limited to, unlawful conduct or actions that may harass, cause distress, or inconvenience any individual, as well as the transmission of obscene or offensive content or disruptions to the normal flow of communication on the Website.

 

Liability

Vicky Moore shall not be held responsible for any consequences resulting from the use of the Website, including product orders, which encompass:

• Losses that were not reasonably predictable by both parties when the contract was formed.

• Losses not arising from any supplier's breach.

• Business losses and losses affecting non-consumers.

It's important to note that I do not exclude or limit my liability in the following situations:

(a) Cases involving death or personal injury due to our negligence.

(b) Instances of fraud or fraudulent misrepresentation.

(c) Breach of the terms outlined in section 12 of the Sale of Goods Act 1979, which pertains to title and peaceful possession.

(d) Breach of the terms stipulated in sections 13 to 15 of the Sale of Goods Act 1979, covering description, satisfactory quality, fitness for purpose, samples, and more.

(e) Matters involving defective products under the Consumer Protection Act 1987.

Intellectual property 

Vicky Moore is the owner of the site, including its original content, features, and functions. These elements are safeguarded by a range of international laws, including copyright, trademark, patent, trade secrets, and other intellectual property rights. 

Contract formation

All orders placed on the website are contingent upon acceptance and product availability. I have the discretion to decline your order for any valid reason.

While product prices are accurate at the time of data entry, I retain the right to modify prices without prior notice. Rest assured, if such a price alteration affects your order, I will notify you.

A contract between you and Vicky Moore is only established when:

1. I confirm your order's dispatch by sending you a confirmation email for physical items. 

 

 

 

Cancellations

If you're a consumer within the EU or UK, you possess a legal entitlement according to the Consumer Protection (Distance Selling) Regulations of 2000. This right allows you to cancel your order within fourteen (14) working days from when you receive the goods. Refunds for orders canceled under these regulations will be handled in alignment with your legal entitlements.

 

Governing Law

These terms are governed by the laws of England and Wales.

Vicky Moore reserves the right to amend these terms and conditions from time to time without notice.

Waiver

If any part of these terms is deemed invalid or unenforceable, the remaining provisions continue to apply in their entirety. Vicky Moore's failure to enforce these terms on any occasion does not relinquish Vicky Moore's rights, and I can still enforce them in the future.
